شرکت الماس نشان البرز (که در ادامه به عنوان "شرکت" نامیده می‌شود) به‌عنوان مالک و ارائه‌دهنده پلتفرم دربست، خدمات حمل‌ونقل آنلاین را از طریق این اپلیکیشن به کاربران ارائه می‌کند. کاربران با ثبت‌نام و استفاده از این پلتفرم، موافقت خود را با تمامی قوانین و مقررات زیر اعلام می‌نمایند. عدم رعایت این قوانین ممکن است به مسدود شدن دسترسی کاربر یا پیگرد قانونی منجر شود.تعاریف و اصطلاحات
- الماس نشان البرز: شرکتی که پلتفرم دربست را طراحی و مدیریت می‌کند.
- دربست: یک نرم‌افزار آنلاین که امکان ارتباط بین رانندگان و مسافران را برای تسهیل حمل‌ونقل فراهم می‌کند.
- راننده: شخصی که پس از احراز هویت و تأیید مدارک توسط شرکت، خدمات حمل‌ونقل را از طریق پلتفرم ارائه می‌دهد.
- مسافر: شخصی که از پلتفرم دربست برای درخواست خدمات حمل‌ونقل استفاده می‌کند.
- کاربر: هر شخص حقیقی یا حقوقی که از خدمات اپلیکیشن دربست استفاده می‌کند.
شرایط استفاده از خدمات
- کاربران موظف‌اند حداقل ۱۸ سال سن داشته و دارای شماره تلفن همراه معتبر باشند.
- کاربران باید اطلاعات خود (شامل نام، شماره تماس و مدارک شناسایی) را دقیق و به‌روز وارد نمایند. ارائه اطلاعات نادرست یا ناقص موجب مسدود شدن حساب کاربری خواهد شد.
- استفاده از خدمات دربست تنها برای مقاصد شخصی مجاز است و هرگونه استفاده تجاری، غیرقانونی یا انتقال حساب کاربری به شخص ثالث ممنوع است.
- کاربران موظف‌اند در تعامل با سایر کاربران (رانندگان یا مسافران) احترام متقابل را رعایت کرده و از هرگونه اقدام تهدیدآمیز، توهین‌آمیز یا غیرقانونی خودداری کنند.
- رانندگان موظف‌اند خودروهای خود را در شرایط مناسب نگهداری کرده و تمامی مدارک موردنیاز (مانند گواهینامه رانندگی، بیمه معتبر و کارت شناسایی خودرو) را در اختیار داشته باشند.
مسئولیت‌ها
مسئولیت کاربران
- کاربران (مسافران و رانندگان) مسئول محتوایی هستند که در پلتفرم دربست ارسال یا منتشر می‌کنند. شرکت هیچ مسئولیتی در قبال محتوای منتشر شده توسط کاربران ندارد.
- مسافران موظف‌اند تنها خدماتی را درخواست کنند که با قوانین جمهوری اسلامی ایران مطابقت داشته باشد.
- رانندگان موظف‌اند خدمات حمل‌ونقل را طبق قوانین راهنمایی و رانندگی ارائه دهند و در هر شرایطی ایمنی مسافران را تضمین کنند.
مسئولیت شرکت
- شرکت تنها یک بستر ارتباطی میان رانندگان و مسافران فراهم می‌کند و خود ارائه‌دهنده خدمات حمل‌ونقل نیست.
- شرکت مسئولیتی در قبال حوادث، خسارات یا مشکلاتی که در طول سفر بین راننده و مسافر رخ می‌دهد، ندارد.
- شرکت تلاش می‌کند تا امنیت اطلاعات کاربران را تضمین کند، اما مسئولیتی در قبال دسترسی غیرمجاز یا حملات سایبری ندارد که ناشی از کوتاهی یا سوءاستفاده کاربر باشد.
پرداخت‌ها و هزینه‌ها
- هزینه سفرها بر اساس عوامل مختلفی از جمله مسافت، زمان، و شرایط سفر محاسبه می‌شود. این هزینه ممکن است بدون اطلاع قبلی تغییر کند.
- کاربران موظف‌اند هزینه خدمات را به‌طور کامل و به موقع پرداخت کنند. عدم پرداخت هزینه یا تلاش برای تقلب مالی ممکن است به مسدود شدن حساب کاربری منجر شود.
- تمامی هزینه‌ها و کمیسیون‌ها مستقیماً توسط شرکت تعیین می‌شوند و کاربران نمی‌توانند در این خصوص اعتراضی داشته باشند.
- رانندگان مسئول پرداخت مالیات‌های مربوط به درآمد خود هستند و شرکت هیچ تعهدی در قبال این موضوع ندارد.
امنیت و حریم خصوصی
- شرکت متعهد است اطلاعات شخصی کاربران را محرمانه نگه دارد و آن‌ها را به هیچ شخص یا سازمانی بدون مجوز قانونی منتقل نکند.
- کاربران موظف‌اند حساب کاربری خود را ایمن نگه داشته و از اشتراک‌گذاری اطلاعات ورود با دیگران خودداری کنند.
- شرکت می‌تواند اطلاعات کاربران را برای بهبود خدمات یا تحلیل آماری استفاده کند، اما این اطلاعات به‌صورت ناشناس مورد استفاده قرار خواهند گرفت.
- هرگونه تلاش برای نفوذ به سیستم‌های اپلیکیشن دربست یا سوءاستفاده از اطلاعات دیگران منجر به پیگرد قانونی خواهد شد.
استفاده از اطلاعات موقعیت مکانی
اپلیکیشن دربست برای ارائه خدمات اصلی خود از اطلاعات موقعیت مکانی استفاده می‌کند، از جمله:
- اتصال مسافران به رانندگان نزدیک.
- تعیین دقیق مبدا و مقصد سفر.
- بهبود مسیر و پیگیری لحظه‌ای سفر.
زمان جمع‌آوری اطلاعات موقعیت مکانی:
- در هنگام استفاده از اپلیکیشن (پیش‌زمینه): اطلاعات مکان برای پیدا کردن سفر مناسب و پیگیری لحظه‌ای جمع‌آوری می‌شود.
- در پس‌زمینه: برای رانندگان، ممکن است اطلاعات مکان در پس‌زمینه نیز جمع‌آوری شود تا وضعیت سفر به‌روز بماند و مکان راننده به‌درستی نمایش داده شود.
اشتراک‌گذاری داده‌ها:
اطلاعات موقعیت مکانی ممکن است با خدمات شخص ثالث مانند ارائه‌دهندگان نقشه و مسیریابی فقط برای اهداف مربوط به خدمات به اشتراک گذاشته شود. این داده‌ها به هیچ عنوان برای تبلیغات یا اهداف غیرمرتبط به فروش نمی‌رسد و اشتراک‌گذاری نمی‌شود.
کنترل کاربران:
کاربران می‌توانند در هر زمان دسترسی به مکان را از طریق تنظیمات دستگاه مدیریت کنند. غیرفعال کردن دسترسی به مکان ممکن است عملکرد اصلی اپلیکیشن را تحت تاثیر قرار دهد.
محدودیت‌های مسئولیت
- شرکت هیچ‌گونه تضمینی در خصوص دسترسی دائمی یا بدون وقفه به خدمات دربست ارائه نمی‌دهد.
- در صورت وقوع وقایع غیرمنتظره مانند بلایای طبیعی، حملات سایبری، یا مشکلات فنی، شرکت مسئولیتی در قبال خسارات ناشی از عدم ارائه خدمات نخواهد داشت.
- کاربران موافقت می‌کنند که شرکت را از هرگونه ادعا، خسارت یا دعوای حقوقی که ناشی از استفاده آن‌ها از اپلیکیشن است، مبرا سازند.
تغییر در قوانین و مقررات
- شرکت حق دارد قوانین و مقررات را در هر زمان و بدون اطلاع قبلی تغییر دهد. کاربران موظف‌اند به‌طور دوره‌ای این شرایط را مرور کنند.
- ادامه استفاده از خدمات پس از اعمال تغییرات به منزله پذیرش شرایط جدید خواهد بود.
حقوق مالکیت فکری
- تمامی حقوق مالکیت فکری مرتبط با اپلیکیشن دربست (از جمله نام تجاری، لوگو، نرم‌افزار و طراحی) متعلق به شرکت است.
- کاربران نمی‌توانند هیچ بخشی از نرم‌افزار یا محتوا را تکثیر، تغییر، یا توزیع کنند مگر با مجوز کتبی شرکت.
اختلافات و شکایات
- تمامی اختلافات ناشی از استفاده از خدمات دربست باید از طریق مذاکره دوستانه حل‌وفصل شوند.
- در صورت عدم حل اختلاف، موضوع به مراجع قانونی صالح ارجاع خواهد شد.
- شرکت این حق را برای خود محفوظ می‌دارد که در صورت بروز تخلفات جدی، حساب کاربر را به‌طور دائمی مسدود کند.
ارتباط با پشتیبانی
- کاربران می‌توانند از طریق روش‌های ذکر شده در صفحه تماس با ما مشکلات، سوالات یا شکایات خود را با تیم پشتیبانی در میان بگذارند.
- رفتار محترمانه در تماس با پشتیبانی الزامی است. هرگونه رفتار توهین‌آمیز یا تهدیدآمیز منجر به قطع خدمات خواهد شد.
تعهدات کاربران
- کاربران موافقت می‌کنند که قوانین راهنمایی و رانندگی را رعایت کنند و هیچ‌گونه اقدامی که خلاف قانون باشد انجام ندهند.
- کاربران متعهدند از اطلاعات و خدمات پلتفرم فقط برای اهداف قانونی و مجاز استفاده کنند.
احترام به قانون
هرگونه استفاده از خدمات دربست باید با رعایت قوانین جمهوری اسلامی ایران صورت گیرد.با نصب اپلیکیشن یا استفاده از وب اپلیکیشن دربست، شما تمامی قوانین و مقررات فوق را مطالعه و قبول کرده‌اید.

Service Usage Conditions
- Users must be at least 18 years old and have a valid mobile phone number.
- Users must enter accurate and up-to-date personal information (name, contact number, and identification documents). Providing false or incomplete information may result in account suspension.
- Services may only be used for personal purposes. Commercial, illegal use, or transferring the account to third parties is prohibited.
- Users must interact respectfully with other users (drivers or passengers) and avoid any threatening, offensive, or illegal behavior.
- Drivers are responsible for maintaining their vehicles in proper condition and must carry all required documents (such as a valid driver’s license, insurance, and vehicle registration card).
Responsibilities
User Responsibilities
- Users (passengers and drivers) are responsible for the content they send or publish on the Darbast platform. The Company holds no responsibility for user-generated content.
- Passengers must only request services in compliance with the laws of the Islamic Republic of Iran.
- Drivers must provide transportation services in accordance with traffic regulations and ensure passenger safety at all times.
Company Responsibilities
- The Company only provides a communication platform between drivers and passengers and is not a transportation service provider itself.
- The Company is not responsible for accidents, damages, or issues that occur during trips between drivers and passengers.
- The Company strives to ensure the security of user data but is not liable for unauthorized access or cyberattacks caused by user negligence or misuse.
Payments and Fees
- Trip costs are calculated based on various factors including distance, time, and trip conditions. These costs may change without prior notice.
- Users are obliged to pay service fees fully and on time. Failure to pay or attempts at financial fraud may lead to account suspension.
- All costs and commissions are determined solely by the Company, and users may not dispute them.
- Drivers are responsible for paying taxes on their earnings, and the Company holds no obligation regarding this matter.
Security and Privacy
- The Company is committed to keeping users' personal information confidential and will not share it with any person or organization without legal permission, except as required to deliver services.
- Users are responsible for securing their accounts and must not share login details with others.
- The Company may use user data for service improvement, research, or statistical analysis. Such data will be anonymized whenever possible.
- Any attempt to hack the Darbast systems or misuse others' information will result in legal prosecution.
Location Data Usage
Darbast collects and uses location data to deliver core ride-hailing services, including:
- Connecting passengers with nearby drivers.
- Determining accurate pickup and drop-off locations.
- Enabling real-time route tracking and improving trip efficiency.
When We Collect Location Data:
- When the app is in use (foreground): We collect real-time location data to find nearby rides and monitor trips.
- When the app is running in the background: For driver users, location data may be collected in the background to ensure continuous ride tracking and accurate status updates.
Data Sharing:
Location data may be shared with third-party services (such as mapping or navigation providers) only for service delivery purposes. We do not sell or share location data for advertising or unrelated purposes.
User Control:
Users can manage location permissions at any time through their device settings. Please note that disabling location access may affect the core functionality of the app.
Liability Limitations
- The Company does not guarantee uninterrupted or continuous access to Darbast services.
- In case of unexpected events such as natural disasters, cyberattacks, or technical issues, the Company is not liable for service interruptions or resulting damages.
- Users agree to release the Company from any claims, damages, or lawsuits arising from their use of the application.
Changes to Terms and Conditions
- The Company reserves the right to change these terms and conditions at any time without prior notice. Users are required to review these terms periodically.
- Continuing to use the services after changes are applied implies acceptance of the new terms.
Intellectual Property Rights
